Ohio Murder Shines National Spotlight On LGBT Violence: Kendall L. Hampton, a 26-year-old gender non-conforming person, was found dead in Cincinnati late Saturday night.


The National Coalition of Anti-Violence Programs is calling attention to the fatal shooting of Kendall L. Hampton, a gender non-conforming person who had allegedly engaged in acts of sex work.
The 26-year-old victim was discovered in the parking lot of a Cincinatti convenience store last Saturday, reported FOX19. Hampton was pronounced dead later that night at the city’s University Hospital. Police are currently searching for the gunman.
The NCAVP, along with the Buckeye Region Anti-Violence Organization, is working to determine if gender identity or race were motivators in the crime. Apart from Hampton, the organization has learned of the murders of eight people this year who identified as transgender or were gender non-conforming.
According to a recent report by NCAVP, 87% of the 30 reported hate murder victims in 2011 were LGBT people of color. The organization encourages those affected by violence to contact their nearest anti-violence program, which may be found on its website.

A murder occurred in Oakland early Sunday morning. As of this posting, there is exactly one — count it — one, article about the incident in the media, at least as measured by Google News hits for Oakland murder.

37-year-old Brandy Martell was sitting behind the wheel of her car around 5:15 a.m. at when one or two men walked up and began a conversation. A witness told ABC7 the conversation was cordial, but then.. one of the men became angry and fired into the car right where Martell was sitting.

“When you don’t provide a space in society for people who you think are the other or different, especially transgender women, especially transgender women of color, when you don’t provide spaces for them to be in a safe environment or a safe space, whether it’s socializing or services, this is what happens,” Martell’s friend Tiffany Woods told ABC7.

As Horace Boothryd’s breaking diary yesterday noted, there was an email notice send out about the murder Sunday evening, with a damning claim about police inaction.

Brandi, a transwoman, was murdered last night, shot at 12th and Franklin in Downtown Oakland after an altercation with a man who became enraged and shot her when he realized she was trans. An amazing #oo comrade tried to keep her alive with training learned from the People’s Community Medics, but the cops walked away and the ambulance came too late.

If you are doubting whether this could possibly be true, I suggest you read Politicized ‘Hate Crimes’, the OPD and District Attorney O’Malley, and judge for yourself.

It is true that Oakland is a high-crime city, at least if you consider the data per capita. But Oakland is just not that populous, so that you might think that each of the some 110+ murders a year that occur within its boundaries would garner significant media attention. But as of five o’clock today Oakland’s flagship newspaper, the Oakland Tribune, had absolutely nothing about a rather shocking crime that took place just a block from Frank Ogawa Plaza / Oscar Grant Park.

Think about what the newscape would look like if a well-heeled, white, Oakland citizen living on “the right side of the tracks” (or, in Oakland parlance, “the hills”) had been the victim. Or consider that another murder that took place at almost the same location in November of 2011 while Occupy Oakland was camping in the Plaza rated world-wide headlines. I will leave it as an exercise to the reader to determine how many articles there were about broken windows in Oakland on November 2nd, 2011.  

So this is how yet another (and another, and another and another) transgender woman dies; a victim simultaneously of hatred and a conspiracy of silence.

The National Coalition of Anti-Violence Programs (NCAVP) and allied lesbian, gay, bisexual, transgender, and queer (LGBTQ) organizations stand in solidarity with Cece McDonald, a young African American transgender woman violently attacked by a group of people in a racist and transphobic hate violence incident in June 2011 in Minneapolis, Minnesota.  Despite being the survivor of this incident of violence, CeCe McDonald was the only person arrested.  Hennepin County Attorney Michael Freeman has charged McDonald with two counts of second-degree murder for acting in self-defense and allegedly fatally stabbing one of her attackers.  Hennepin County has dropped murder charges in three similar cases where people have acted in self-defense.  NCAVP and our allies add our support to the public outcry to drop the charges against CeCe McDonald.

Transgender women of color face severe and deadly hate violence in the United States.  NCAVP has responded to three murders of transgender women in the month of April alone.  NCAVP’s most recent report, Hate Violence Against Lesbian, Gay, Bisexual, Transgender, Queer and HIV-Affected Communities in the United States in 2010, documented 27 anti-LGBTQH murders, the second highest yearly total ever recorded by the coalition.  Transgender women made up 44% of the 27 reported hate murders in 2010, while representing only 11% of total survivors and victims. Transgender people represented a higher proportion of hate violence survivors with serious injuries (11.8%) as compared to non-transgender men (6.2%) or non-transgender women (1.3%). 

The report also showed that transgender people and people of color were the least likely to receive medical attention, and that transgender people of color reported higher rates of negative law enforcement experiences.  NCAVP members know that transgender survivors of violence often face biased and discriminatory treatment from law enforcement, courts, and other first responders.  We are concerned that Mcdonald could be facing discriminatory charges based on her transgender identity.  While we do not have all the details about this incident, our experience tells us to strongly advocate that Hennepin County consider CeCe McDonald as acting in self-defense.

NCAVP does not condone violence and expresses our condolences that a life has been lost in this incident.  However, self-defense is not murder, and McDonald should not face murder charges for acting to defend her own life in a racist, transphobic assault.  Charging McDonald with murder while other non-transgender people have not been charged by Hennepin County in similar cases where defendants were acting in self-defense highlights the potential differential treatment placed on McDonald because she is transgender.  Furthermore, in a society where violence against transgender people is all too often condoned, ignored, and unsolved, charging McDonald with murder minimizes transphobic violence and reinforces a transphobic culture.

NCAVP and our allies call for Hennepin County to drop the charges against CeCe McDonald and for community members, anti-violence organizations, and public officials to take immediate action to support survivors of transphobic violence.

Sign the Petition: Join Change.org in calling on County Attorney Michael Freeman to honor his committment, in his words “to serve all of our citizens with understanding, dignity, and respect” by dropping the charges against CeCe McDonald.

Trans Activist Agnes Torres Murdered In Puebla

Trans activist and respected counselor Agnes Torres Hernández was found dead this past Saturday near the town of Atlixco, Puebla. Reports indicate she was tortured before being killed.

Friends and supporters gathered to mourn and pay tribute to Agnes this evening in Puebla, the state’s capital city. Earlier today, the hashtag #AgnesTorres was a trending topic on Twitter, with thousands posting messages of support for Agnes, her family, and the LGBT community.

Former colleagues of Agnes Torres are demanding a thorough investigation and calling for a special department within Mexico’s National Human Rights Commission dedicated to cases of hate crimes against lesbians, gays, and transsexuals.

Kuwaiti police have tortured and sexually abused transgender women using a discriminatory law, passed in 2007, which arbitrarily criminalizes “imitating the opposite sex,” Human Rights Watch said in a report released today. The government of Kuwait should repeal the law, article 198 as amended in 2007, and hold police officers accountable for misconduct.

The 63-page report, “‘They Hunt us Down for Fun’: Discrimination and Police Violence Against Transgender Women in Kuwait,” documents the physical, sexual, and emotional abuse and persecution that transgender women – individuals who are born male, but identify as female – have faced at the hands of police. The report also documents the discrimination that transgender women have faced on a daily basis – including by members of the public – as a result of the law, an amendment to penal code article 198. Based on interviews with 40 transgender women, as well as with ministry of interior officials, lawyers, doctors, and members of Kuwaiti civil society, the report found that the arbitrary, ill-defined provisions of the law has allowed for numerous abuses to take place.

Last summer, CeCe McDonald, a young African American transgender woman, was violently attacked in the heart of South Minneapolis. As she and several friends, also African American and queer or allied, were walking to the grocery store, a group of white adults standing outside of a bar started shouting racist and transphobic insults at them, calling the youth “faggots,” “niggers,” and “chicks with dicks”. Tragically, the violence did not stop there- one of the white adults slashed CeCe across the face with a broken bottle, cutting all the way through her cheek, and another of the attackers was fatally stabbed. Amazingly, in the aftermath of this racist and transphobic attack, the only person facing charges is CeCe McDonald- the victim. Michael Freeman, the Hennepin County Attorney, has charged CeCe with two counts of second degree murder. Because of these charges, she has been unable to recover from the attack and prevented from continuing her studies at the Minneapolis Community Technical College. Considering that County Attorney Michael Freeman has dropped charges in similar situations this year and that he has advocated strongly for programs to keep kids in school, arguing “We all know that when kids miss school they don’t learn,” why is Michael Freeman ruthlessly going after this young student? We refuse to allow racism and transphobia, on Minnapolis streets or in Minneapolis courts. We support CeCe. We are waiting for County Attorney Michael Freeman to honor his committment, in his words “to serve all of our citizens with understanding, dignity, and respect” by dropping the charges against CeCe McDonald.
